Federal law requires the Department of Education to mail a 60-Day Notice of Intent to Offset to your last known address before intercepting your tax refund. Three Ways to Stop an Imminent Tax Refund Offset

  1. Rehabilitate or Consolidate Before Offset: Enrolling in a loan rehabilitation agreement or executing a Direct Consolidation loan restores your loans to good standing and removes your debt from the Treasury offset database.
  2. Injured Spouse Allocation (IRS Form 8379): If you are filing a joint federal return and your spouse is not legally liable for the defaulted student debt, your spouse can file Form 8379 (Injured Spouse Allocation) to recover their proportional share of the joint tax refund.
